The British Residents’ Association was represented at the recent Bar Council presentation in Kyrenia. We were promised contact from the Council to discuss proposed legislation intended to control and discipline lawyers. They also offered to talk about ways to better inform expatriates about legal pitfalls. We are still waiting for the promised contact.
In the meantime our members continue to tell us about cases where they have lost money (and even property) because their lawyers appear not to have protected their interests.
There is much to be done…

  • EU property decisions now contradict each other
    There is some misunderstanding here about the two Courts.

    The ECJ is the highest Court of the EU.

    The ECHR is the Court established under the European Convention on Human Rights, a convention established and signed by the 47 members of the Council of Europe, a body separate from the EU

    So the ECHR does not have primacy over the ECJ. However, it is a pity that the ECHR ruling did not come before the ECJ ruling. There is little doubt that the ECJ would have taken into consideration the ECHR ruling had it been available at the time. But it might not have changed their view.

    If the developers have any assets in the UK or elsewhere in Europe, have the developers considered legal action outside TRNC?
