Boycott north Cyprus builders refusing to accept court judgements?
The case of Don and Sheila Vango is yet another example of a builder refusing to honour the verdict of a court case. In the Vangos’ case the court awarded them £175,000 plus interest because the house built by Ismail Beydola had to be condemned. Beydola blamed the reason he is not paying the award on the effect the bad publicity has had on this other businesses. He pleads poverty plus he will not accept the findings of the Cyprus and Turkish Union of Architects’ and Engineers’ Chamber. According to Cyprus Today, Beydola accuses them of writing a negative report in order to get the Vango’s business.
This attitude has so incensed other property buyers that some are now suggesting that a database of builders should be put together along with other businesses related to them and that this be published in order that those wishing to boycott them could do so. While this seems unfair and extreme, many property owners feel that if the legal system is unable to bring justice, or is too expensive to use, then perhaps other more immediate and inexpensive means should be used.
This suggestion is only just beginning to build up steam and so it is not clear how serious its proposers are. In the past, apathy and lack of leadership has meant that such moves have been doomed from the start but with the multi-million buying power of property owners it would quickly have an impact, especially during these hard times. It would only take an organisation such as HBPG to start the ball rolling and this would build the momentum necessary to make a boycott a credible deterrent for other builders who might be considering avoiding a court judgement.

We’ve had all the name and shame things in the past. The problem is the publicity. How do you get the info into the hands of a potential purchaser.
Sure, we all know where to look after it’s gone bad. We also know all the people who are too scared or too pflegmatic to rock the boat and still believe the builders are nice guys.
PIO/PCO had no effect the builders ignored them so that scheme didn’t work.
The bar are doing nothing ( I presume NCFP still awaits the promised response) ANy builder worth his salt would attempt to right the matter out of court and satisfy the customer. When it runs to a court case then one can only assume the builder has no intention of supplying goods fit for the purpose or fulfilling his contractual obligations.How often have we seen this happen? I can count maybe 4 cases in and around Karsiyaka. One case where 450 houses have allegedly been mortgaged. The Builder has done a houdini and the proud “owners” left holding the baby (not much else). No Kocans, no rights and no redress. Where is the headline? Where is the warning? Did the builder have previous history of “bad practice”? Who knows? Where could one have possibly have found out? What assets doeds the builder have on the island? Is there a way to get a confiscation order? The questions just go on and on. As to other people ruining the builders reputation. That just makes me laugh, they don’t need other people the do the job themselves absolutely perfectly. Much better than they build houses and certainly much better than they adhere to contracts.
May be it would be better to start a list of “safe” companies to deal with. The list would be a) much shorter b) less easy to manipulate and c) may be easier to publicise.

Robin, the only problem with the list of safe companies is that another builder, pretending to be a homebuyer, could say that they had problems with the “safe” builder. The simplicity of just listing builders (and their other businesses) who have refused to honour a judge’s verdict is that it is easily proven that this is truth. It’s just a factual list with no value judgements associated except they will be found under the PROPERTY – IGNORED JUDGEMENTS category.
where is the state to enforce the court order?

Jimmy, it’s a bit like in the UK where you can win a civil case and then find that you have to reapply to the court if the loser refuses to pay. A criminal case is different because the case is then the responsibility of the state.

I still believe in what I told you before, in principle I agree with what you say but I would prefer to see more moderate approaches if we will ever see a solution.

Instead of wasting your time to research who is who and to prepare lists with “bad” developers and so on why don’t you just boycott them all and come to the free side? That would solve all problems wouldn’t it ?

Although the original case is Civil, once the Court Order
is ignored, this constitues Contempt of Court which is a
Criminal offence and punishable by a prison sentence.

unfortunately Polly, as I discovered in the UK, you then go back to the court to listen to a sob story as to why the money couldn’t be paid and the judge sides with them. Outside the court they stick two fingers up at you and drive off in a car worth more than the money they owe you. You then use an alternative cheaper and more immediate way of collecting the money.
