AGA victims asked for more money or court case will be dropped

You may recall that an AGA victim was told that they had to appear in court on December 23rd 2009 (click here) or risk having their case dismissed. The person concerned is a victim of AGA’s double selling scam which was allegedly aided by a well known TRNC lawyer. With only two weeks notice the UK based victim had to provide hospital evidence as to why they could not be present in a TRNC court two days before Christmas.
If this was not enough to disturb their Christmas holiday what happened next certainly did. They had already lost their savings on a property they could not live in and now they were spending the last of their money trying to achieve justice in the TRNC courts. Earlier they had spent £500 paying for a bond which was supposedly insurance in case Gary Robb won the case and then, so close to receiving the judgement they were hoping for, the bombshell came. They were asked by their lawyers for another £1500!
When they paid for and signed a contract several years ago, they expected it to be readily enforced if broken. So when they discovered that it had been broken by AGA Development, because their house was double-sold, they expected something to be done about it. Court cases had been won but what they didn’t know was that TRNC lawyers don’t enforce judgements and even if they did enforce them they now realised that AGA Developments has no assets.
They could give up, but that would be saying goodbye to everything, surely they could at least be given the property they originally paid for, no matter what condition it was in? That was one of the reasons for their court case. But now they were being asked for £1500 STAMP DUTY! To make matters even worse, if that was possible, the duty was being charged on a ridiculous sum of £99,000 when the victim only paid £66,000, something they had told the lawyer on more than one occasion!
They also had evidence of three cases run by other lawyers of AGA victims where the contract stamp duty has not had to be asked to be paid and neither has money for a bond. They were beginning to believe they were being singled out, perhaps to get them to drop the case. First the Christmas court hearing and then when that failed to stop them there came a demand for more money.
It looks like the TRNC government will be paying in excess of £2m to cover the Orams couple’s case and yet they won’t even give the hundreds of AGA victims a minute of their time.

I can only speak from my own experience. I had paid the stamp
duty on my Contract of Sale in 2005 and it is my understanding that it is the action of doing so that makes it legally binding. I did have
to pay stamp duty on the injunctions I managed to obtain on three
villas and a plot of land which was then only assets my builder
Kulaksiz (earless) Construction Limited had unmortgaged in the
Kyrenia area. All stamp duty is in Lire not sterling pounds and the most expensive was 500 Lire I consider it pointless in
pursuing an empty pot, so if you cannot find any assets in the
name of the defendant, why waste your money. Be present when
purchasing the stamps and when the stamp duty is paid over.
Never take anyones word for anything.
My case was heard by three different Judges, the second of whom
had actually been the one to give Akfinans Bank the repossession
judgement so proving that Breach of Contract should have been
easy – not so. The third Judge, a new one to this area was my salvation, asked the pertinent question, which came first the
Contract or the Mortgage and within five appearances awarded in my
favour. He treated the Director of the building company with the
contempt he deserved. Refused the petition by the builders Advocate that I should lodge 5000 Lire with the Court
for their costs should I lose and do a ‘runner’ and restored my
faith a little.
However, the debacle by the High Court in my recent Appeal case
has undermined my faith in the legal system
I can fully understand why ABAG have taken the route they have.

nevertheless i did knew that its common practice for ‘trnc’ to issue trial calls in weird days or just a few days before the actual trial so that the plaintiff will ”loose” the case by not appearing in front of the court.
Its also a way for them to show that they are an organized REAL country with ”firm” rules That even British citizens need to obey.. (napoleon syndrome)
.. just for the sake of truth … its not the ‘trnc’ who paid £2m to cover the Oram’s case, its Turkey mate, and the reason why they did so its because they had something to actual GAIN out of this. NOT because they gave a fuck about Orams..

I will pick you up on one point. GC Builders are selling to
Ex pats and before the purchaser has had the chance to transfer
title to their name, the builder takes out a mortgage which, if
you think about it is the same effect as double selling, the
builder gets money twice. It is upsetting purchasers your side
of the border too. The builder then fails to make payments to the
Bank and naturally the Bank will do whatever is necessary to recoup
the money – guess who is left in the brown stuff?? Clue – not the
builder.

The Cypriot Govement is infact one of the few EU governments that complains that Eu should allow the countries to set Prices on some Basic Stuff so we can avoid this kind of swindling.

So there you go.. since Cyprus entered eu we were forced to lift regulation laws on food prices, Thus leading to some repressed profiteering form the side of the market.
I believe we need to give it more time.. and prices will settle again.

We have asked the EU to see the accounts of where the EU money was sent to in North Cyprus, who had some of it and where they spent it…….No answer.
