Three years ago I was shopping in a well known TRNC supermarket and at the till was told the bill came to 19.90TL. The cashier took my 20TL note and started to scan the next customer’s shopping. I stopped her and asked for my 10 kurus change only to be told that she didn’t have any. I demanded the money but the cashier insisted that she would owe it to me. In front of witnesses I said that I would be charging her 2.5% daily interest on this debt. She laughed her acceptance and carried on working.
Today I am preparing to notify the court about this outstanding debt and have just discovered that the supermarket now owes me 5TL plus court costs, a sum of about 500TL altogether. OK, so this is just a joke but unfortunately not one shared by “Ozangirl” on Cyprus 44.
“On Tuesday this week a Bailiff arrived at my house with a court order, I initially thought oh my god the Greeks have come for the house!! but no, it turned out that it was a Court order for 1 month’s outstanding payment from nearly 3 year’s ago from Guvence School in Ozankoy!!! At the time (nearly 3 year’s ago) we pulled our son out of Guvence school at the end of term in the May and decided to instead take him out and teach him ourselves due to the severe lack of education he was receiving/ we paid for at this school, we also duly informed the school of our intentions as we did not feel happy paying for something he did not get. Anyway, 3 year’s down the line, no verbal communication or letter or bill we instead get a court order! The best part to come…. not only did we owe 262 Euros for the month outstanding, but a daily interest for the last 3 years at 2.5% – this equated to some 5,500 Euros!!!! mmmm, you can imagine my response! Beware!!!”
I did infact go the school and try to speak to / negotiate with “Meliss” who runs the school but she refused and advised me to go through her lawyer! To cut a long story short, I finally managed to get the fine reduced somewhat through a lawyer and paid up before it went to court as I really didn’t have a leg to stand on. What happened to communication! the woman only lives a short distance from me and see’s me quite regularly. It’s a crazy system over here!”
Looks like the local businesses have taken heart from Akfinans Bank’s success in being able charge usurious interest on a debt and, without informing the debtor in the original contract what rates would be charged, have deliberately allowed the debt to grow to a frightening amount. Even though TRNC constitution commentators indicate that such practices have no grounds for legality, the current government’s inaction is allowing businesses to terrorise those not taking care during business transactions. The weapon they use is the writ which seems to imply that the debt is proven and that the accused has to defend themselves at great cost in the courts. The legal profession must think that Christmas is around the corner!
